The Disciplinary Process

Texas dentists can expect the first step in a disciplinary proceeding to begin with an investigation by the Board of Dental Examiner's Enforcement Division. There are eleven people employed in this division which include a director, eight investigators, and two technicians. They are charged with investigating complaints against dentists, dental hygienists, and dental laboratories. During this period, you will be expected to provide all requested documents and answer any questions submitted by the investigator.

Once all of the evidence has been gathered and reviewed, the Texas Secretary of the Dental Board may choose to dismiss the charges. The case may be referred instead to a settlement conference, this being the most common resolution following the filing of a complaint. In some instances, a hearing may be required in front of an administrative law judge. The decisions reached both in settlement conferences and hearings in front a judge are voted on by the Board and then monitored for compliance.
